Trial Opinions
Over-age employees are those over the legal retirement age and under the age of 65.
Interns are eligible students of vocational schools/colleges/universities in Shanghai, who have agreed with the employer for an internship period of one month or more.
If over-age employees and interns participate in work-related injury insurance, the employer shall register for them per the employment and internship agreement.
Social insurance agency will stop payments after expiration of employment agreement.
Employer to inform social insurance agency of early termination/renewal of agreement.
Opinions specify the calculation of payment rate for over-age employees and interns.
Specify the claims arrangements for accidents/occupational diseases, and in the scenario that staff become disabled due to work, with a fifth to tenth grade disability.
Benefit expenses beyond the scope the work-related injury insurance shall be settled through negotiation between the employer and the over-age employee/intern.
If the negotiation fails, they may resolve through civil litigation/other legal channels.
Over-age employees employed in engineering construction projects shall be subject to relevant policies and regulations for engineering construction projects by the state/city.
Employers shall educate their staff re occupational disease/accidents prevention.
